The "Five-in-Five" Rule Just Changed How Long Student-Athletes Can Earn

On June 23, 2026, the NCAA Division I Cabinet adopted a new age-based eligibility model, nicknamed "five-in-five." Athletes who enroll full-time no later than the academic year after their 19th birthday now get five years of eligibility, with season-of-competition limits, redshirt rules, and most eligibility waivers removed entirely.

The model takes effect for athletes first enrolling in fall 2027 or later. Athletes enrolling this fall, or currently competing with eligibility remaining after the 2025-26 season, get to choose whichever framework works better for them: the old four-seasons-in-five-years rule, or the new age-based model.

Limited pauses still apply for circumstances like pregnancy, active-duty military service, or religious missions.

Eligibility length determines earning length. Every revenue-share agreement, every NIL licensing clause, every exclusivity provision an athlete signs is built around an assumed timeline, how many seasons the school expects to have access to that athlete's name, image, and likeness.

When the eligibility clock changes, the economic assumptions baked into existing contract language change with it.

Three things every athlete (and every agent advising one) should check right now:

1. Does your revenue-share or NIL agreement define the license period by season count, by academic year, or by "entire period of eligibility"?

Open-ended language tied to eligibility now potentially covers more real time than it did a month ago.

2. If you're weighing the old rule against the new one, model out both scenarios before you commit to a school or a deal structure, the more favourable eligibility path may not be the more favourable earnings path once you factor in exclusivity terms.

3. If you're a transfer-eligible athlete, confirm whether your current school's exclusivity clause survives a transfer, and for how long. Longer eligibility windows raise the stakes of getting this wrong.
